DRIVING UNDER THE INFLUENCE (DUI) DEFENSE

If you are a minor and were arrested for operating a motor vehicle after the officer believed you had consumed alcohol then you can be charged with a DUI.  In an ALR hearing the officer must be able to prove that he had reason to 1) pull over the car and 2) believe the minor had consumed alcohol. 

PENALTIES IF CONVICTED

Do not worry about going to Travis County Jail. Civil and Criminal penalties for DUI are significantly less than those for a DWI conviction, however, the DPS can suspend the license automatically for 60-120 days.  If convicted of a DUI, which is a class “C” misdemeanor, minors are subject to a maximum $500.00 fine plus court costs, alcohol education classes, and community service for a first time offender.  Second time offenders are subject to even higher fines and possible jail time.  Compared to the maximum $2,000 fine and no less than 3 days in jail sentence affixed to a DWI conviction, DUI violations are treated less serious.

Minors can, however, get charged with a Driving While Intoxicated violation if the officer at the time believes the driver has had enough to drink that he is, in fact, intoxicated.  In these cases minors will be tried in civil and criminal courts as adults.  A DWI is a class “B” misdemeanor and carries the penalties listed above.
